Texas Mini-TCPA Law: What You Need to Know
This information is for education only and isn't legal advice. Talk to a lawyer about your situation.
What changed
Texas amended its telemarketing law (Chapter 302 of the Business & Commerce Code). It used to cover voice calls; from September 1, 2025 it also covers marketing text messages.
Who it applies to
It applies to "sellers" and "telephone solicitors" sending marketing texts to people in Texas, wherever the business is located. For example:
- A California business texting Texas consumers may be covered.
- A Texas business texting customers in other states may be covered.
Exemptions
Exemptions exist but are narrow, for example:
- 501(c)(3) non-profits.
- Retailers with physical stores that have operated under the same name for at least two years (other conditions apply).
- Businesses contacting current or former customers, if they have operated under the same name for at least two years.
You must be able to prove you qualify.
If you're not exempt
You may need to:
- File a registration statement with the Texas Secretary of State. The information becomes public.
- Pay a registration fee and renew each year.
- Post a security bond or equivalent.
- Follow disclosure rules and quiet-hours limits.
What to do now
- Review whether you send marketing texts to Texas residents.
- Check if an exemption applies, with legal advice.
- Keep clear consent records and honor opt-outs.
